According to a draft of a population control law 2021 posted on the UP Law Commission website, anyone with more than two children will be prohibited from participating in local body elections, seeking government jobs, or getting any sort of subsidy.

The proposed measure, for which public input is being sought until July 19, also prohibits persons from advancing in government positions.

Opposition parties have slammed the measure, with the Congress calling it a “political agenda” ahead of the Assembly elections next year. The move was dubbed “democratic murder” by the Samajwadi Party.

“The State Law Commission, UP, is working on management, stabilization, and welfare of the state’s population and has developed a draft law,” according to the UPSLC website.

The provisions of the draft named The Uttar Pradesh Population (Control, Stabilization, and Welfare) Bill, 2021, would take effect one year after publication in the Gazette if enacted.

“Public servants who adopt the two-child norm will receive two additional increments during the entire service, maternity or, as the case may be, paternity leave of 12 months, with full salary and allowances, and a 3% increase in the employer’s contribution fund under the National UP Pension Scheme,” according to the draft bill.

For its execution, a state population fund will be established. The proposed bill states that maternity centers would be established at all primary health centers, among other government responsibilities.

The centers and NGOs will provide contraceptive tablets and condoms, educate community health workers on family planning techniques, and enforce mandatory registration of pregnancies, deliveries, births, and deaths across the state, according to the report.

The draft bill also states that it is the government’s responsibility to implement an obligatory population control topic in all secondary schools.

According to the bill’s draft, “There are limited ecological and economic resources in Uttar Pradesh. The supply of basic human requirements such as inexpensive food, safe drinking water, good housing, access to excellent education, economic/livelihood possibilities, power/electricity for home consumption, and a secure living environment is required and urgent for all inhabitants.”

It argues that in order to promote sustainable development with more fair distribution, the state’s population must be controlled and stabilized.

Ashutosh Sinha, a member of the Samajwadi Party’s Legislative Council, reacted to the text of the proposed law by saying, “Bringing this measure forward is tantamount to assassinating democracy. The Uttar Pradesh administration has made an inexperienced choice.”

Defining the action as a “”The RSS and BJP leaders talk of expanding the population,” UP Congress spokesman Ashok Singh stated in a Hindi tweet ahead of the Assembly elections. The Centre’s focus is on population control. Yogi Adityanath (CM) has introduced the law in anticipation of the next UP Assembly elections.”

Iqbal Mehmood, a Sambhal MLA, warned in June that any population limitation legislation would be a “conspiracy” against Muslims.

“The Dalits and tribals, not Muslims, are responsible for the increase in the country’s population,” the SP MLA had stated.

The Sambhal lawmaker went on to say that Muslims have already realized the importance of having two or three children and that the “growing population” is due to Dalits and tribals.

The action, according to the SP member, was “really an attack on Muslims disguised as population control.”
